1. Agreement to Terms

By accessing and purchasing from the SaudadeSilk website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("Customer," "you," or "your") and SaudadeSilk ("we," "us," or "our"). If you do not agree with any part of these terms, you must not use or make purchases from our Site.

2. Products and Orders

SaudadeSilk sells dresses, jeans, shirts, and blouses online. All product descriptions, images, and prices are subject to change without notice. We reserve the right to limit sales, discontinue products, or correct errors in pricing or product information. Your placement of an order constitutes an offer to purchase, which we may accept or decline at our sole discretion. Order confirmation via email does not signify our acceptance; acceptance is confirmed upon shipment of the item(s).

3. Limitation of Liability

To the fullest extent permitted by applicable law, SaudadeSilk, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or the purchase of our products. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these terms or your use of the Site shall not exceed the amount you paid for the product(s) giving rise to the claim.

The Site and products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

4. Intellectual Property Protection

All content on the SaudadeSilk Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of SaudadeSilk or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

The "SaudadeSilk" name and logo, and all related product and service names, designs, and slogans are trademarks of SaudadeSilk. You are not permitted to use these marks without our prior written consent. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Site content for any commercial purpose without our express written permission.

5. Refund & Return Policy

We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible items within 30 days of the original shipment date for a refund or exchange, subject to the following conditions:

  • The item must be unused, unworn, and in its original condition with all tags attached.
  • The item must be in its original packaging.
  • A copy of the original order confirmation or receipt must be included.
  • Final sale items, personalized items, and items marked as non-returnable are not eligible for return.

To initiate a return, please contact our customer support team at [email protected] to obtain a Return Merchandise Authorization (RMA) number and instructions. Return shipping costs are the responsibility of the customer, unless the return is due to our error (e.g., wrong or defective item shipped).

Refunds will be issued to the original payment method once we receive and inspect the returned item. Please allow 5-10 business days for the refund to be processed after we receive the return. Shipping charges are non-refundable.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
